Dear members and friends of SCL(S),

As an organising member of the SCL(S)’s Conference 2025,  I am incredibly excited to highlight our annual flagship it in this month's newsletter: the SCL(S) Conference 2025: Transformation in the Infrastructure & Energy Sectors.

Please mark your calendars for 25 September 2025, as it will be a significant gathering for the construction industry and involved in the evolving landscape of infrastructure and energy.

We have worked to assemble a strong line-up of speakers, and secured representatives from the energy sector, including individuals from EMA, Sembcorp, MUFG, and Tuas Power. They will share practical insights into energy demands and the strategies being adopted, offering perspectives on the future of energy that are valuable and often sought after.

SOPA Deadlines Under the Microscope: Lessons from the Case of Hiap Seng for Singapore’s Construction Industry

Introduction

The Singapore construction industry is no stranger to the Building and Construction Industry Security of Payment Act 2004 (“SOPA”). For over two decades, SOPA has provided a fast-track mechanism for resolving payment disputes and keeping cash flowing on projects. Yet, as the recent High Court decision in Hiap Seng Building Construction Pte Ltd v Hock Heng Seng Contractor Pte Ltd (“Hiap Seng”) [2024] SGHC 50 demonstrates, the law continues to evolve in ways that are highly significant to contractors, subcontractors, and consultants alike. Hiap Seng adds fresh nuance in at least three areas of practical significance to industry stakeholders: the effect of a payment response served before the due date, the strictness of statutory timelines for adjudication, and the limits of an adjudicator’s jurisdiction where statutory non-compliance is at play....

Programming and Delay Article 3 of 3: Briefing the Delay Claim Expert

Introduction

When projects are delayed and go into dispute, they are often referred to delay experts to provide an opinion on the cause and the impact of the delay events. The first challenge for these experts is to determine the method of delay analysis they will adopt. Many of these methods are described in the Society of Construction Law (United Kingdom) Delay and Disruption Protocol (2nd Edition). The selection of the most appropriate method is highly dependent on the information that is available to the delay expert, not to mention the expert’s own preference.

This article is the third in a series of three articles, that cover:
  • The importance of getting to an accepted programme;
  • Monitoring project progress against the accepted programme; and
  • What to do when delay claims cannot be resolved.

AI in Construction Law: Practical Applications

(30 April 2025)


The AI in Construction Law: Practical Applications seminar on 30 April 2025 was chaired by Ms Lesley Tan, Partner at Wong Partnership, who was accompanied by speakers Ms. Eliza Jiang, CEO and Co-founder of Lawdify, and A/Prof. Dr. Eugene Seah, CEO of DLS Consultancy.

Ms. Lesley Tan kicked off the seminar with insights on trends in the legal industry and generative AI. She highlighted the widespread recognition among legal professionals of the need to adopt AI tools to stay competitive and acknowledged their transformative potential. However, she also emphasised that liability for AI’s mistakes remains with the user. Attendees were briefed on global court guidelines...
